Article 1 – Definitions
In these Terms & Conditions, the following definitions apply:
Cooling-off period:
The period during which the consumer may exercise the right of withdrawal.
Consumer:
A natural person who is not acting in the course of a trade, business or profession and who enters into a distance contract with the trader.
Day:
A calendar day.
Long-term agreement:
A distance contract relating to a series of products and/or services, for which the delivery and/or purchase obligation is spread over time.
Durable data carrier:
Any tool that enables the consumer or trader to store information personally addressed to them in a manner that allows future access and unchanged reproduction.
Right of withdrawal:
The consumer’s option to withdraw from the distance contract within the cooling-off period.
Model withdrawal form:
The form provided by the trader for consumers to exercise the right of withdrawal.
Trader:
The natural or legal person who offers products and/or services to consumers at a distance.
Distance contract:
A contract concluded within a system organised for distance selling using one or more means of distance communication.
Means of distance communication:
A method used to conclude a contract without the parties being physically present at the same time.

Article 3 – Applicability
These Terms & Conditions apply to every offer made by the trader and to every distance contract concluded between the trader and the consumer.
Before a distance contract is concluded, the consumer will be provided with the text of these Terms & Conditions. If this is not reasonably possible, the trader will inform the consumer where the Terms & Conditions may be consulted and that they will be sent free of charge upon request.
If the contract is concluded electronically, the Terms & Conditions may be supplied electronically in such a way that the consumer can store them on a durable data carrier. If this is not reasonably possible, the trader will indicate where the Terms & Conditions can be accessed electronically and that they will be sent free of charge upon request.
If specific product or service conditions apply in addition to these Terms & Conditions, the consumer may always rely on the provision that is most favourable to them in the event of conflicting terms.
If any provision of these Terms & Conditions is null or void, the remaining provisions shall remain in force. The parties shall replace the invalid provision with one that reflects the original intent as closely as possible.
Situations not covered by these Terms & Conditions shall be assessed in the spirit of these Terms & Conditions.
Ambiguities regarding the interpretation of one or more provisions will be interpreted in the spirit of these Terms & Conditions.
Article 4 – The Offer
If an offer has a limited validity period or is subject to conditions, this will be clearly stated.
The offer is non-binding. The trader may modify or amend the offer.
The offer includes a complete and accurate description of the products and/or services. Images used are a true representation of the products and/or services. Obvious mistakes or obvious errors do not bind the trader.
Images, specifications and data are indicative and do not constitute grounds for compensation or termination.
Product images are a true representation; however, colours may vary depending on screen settings.
Each offer clearly states the rights and obligations that apply when accepting the offer, including:

the price, including taxes;
-
possible shipping costs;
-
the method of conclusion;
-
whether the right of withdrawal applies;
-
the method of payment, delivery and performance;
-
the period for which the offer is valid;
-
the minimum duration of the contract in case of long-term agreements;
-
any applicable codes of conduct;
-
the manner in which the consumer can verify or correct submitted data.
Article 5 – The Agreement
The agreement is concluded when the consumer accepts the offer and meets the stated conditions.
If acceptance is made electronically, the trader will confirm receipt electronically. Until this confirmation is received, the consumer may dissolve the contract.
If the agreement is concluded electronically, the trader will implement adequate technical and organisational measures to secure the electronic transfer of data.
The trader may, within legal limits, verify whether the consumer can meet payment obligations and assess any facts relevant to responsibly concluding the contract. If the trader has grounds to refuse the contract, they may decline the order or attach special conditions.
Upon delivery of the product or service, the trader will provide the consumer with the following information in writing or via a durable data carrier:

the trader’s contact address for complaints;
-
the conditions for exercising the right of withdrawal or a clear statement if withdrawal is excluded;
-
information on warranties and after-sales services;
-
details included in Article 4 unless already provided;
-
termination conditions if the agreement exceeds one year.
For long-term agreements, the above applies only to the first delivery.
All agreements are concluded subject to the availability of the ordered products.
Article 6 – Right of Withdrawal
For Products
The consumer may withdraw from the contract within 14 days without providing a reason. The period begins the day after the consumer or a designated representative receives the product.
During the cooling-off period, the consumer shall handle the product and packaging with care and only unpack or use it as necessary to determine whether they wish to keep it.
To exercise the right of withdrawal, the consumer must notify the trader within 14 days using the model form or any other communication method (e.g., email). After notification, the consumer must return the product within 14 days.
If the consumer does not notify or return the product within these periods, the purchase becomes final.
For Services
For services, the consumer may withdraw within at least 14 days from the conclusion of the agreement.
Article 7 – Costs in Case of Withdrawal
If the consumer exercises the right of withdrawal, only the return shipping costs are payable.
Any payments already made will be refunded as soon as possible, and no later than 14 days after withdrawal, provided the trader has received the returned product or proof of return.
Refunds will be made using the same payment method unless the consumer agrees otherwise.
If the product is damaged due to careless handling, the consumer is liable for any depreciation.
The consumer cannot be held liable if legally required information about withdrawal was not provided.
Article 8 – Exclusion of the Right of Withdrawal
The trader may exclude the right of withdrawal for certain products or services, provided this was stated clearly before the contract was concluded.
Exclusion applies to products:
-
made according to consumer specifications;
-
that are clearly personal in nature;
-
that cannot be returned due to their nature;
-
that perish or age quickly;
-
subject to price fluctuations beyond the trader’s control;
-
newspapers and magazines;
-
audio/video products and software once sealed packaging is opened;
-
hygiene-related products once sealed packaging is opened.
Exclusion applies to services:
-
relating to accommodation, transport, catering or leisure services on specific dates;
-
started with the consumer’s express consent before the cooling-off period ends;
-
relating to betting or lotteries.
Article 9 – Prices
For the validity period of the offer, prices will not be increased except due to VAT changes.
Products dependent on financial market fluctuations may have variable prices; these are indicated as guide prices.
Price increases within 3 months are only allowed due to legal changes. After 3 months, price increases require the consumer’s right to terminate.
All prices include VAT.
Typographical or printing errors are not binding.
Article 10 – Conformity and Warranty
The trader guarantees that products and/or services conform to the agreement, specifications, reasonable expectations of reliability and usability, and legal requirements.
A warranty provided by the trader, manufacturer or importer does not affect statutory consumer rights.
Defects must be reported within 2 months of discovery. Returns must be sent in original packaging and in new condition.
The warranty period corresponds to the manufacturer’s warranty.
Warranty does not apply if:
-
the consumer or third parties repair or modify the product;
-
products are exposed to abnormal conditions, misuse or contrary to instructions;
-
defects arise from government regulations regarding materials.
Article 11 – Delivery and Execution
The trader handles orders with care.
The place of delivery is the address provided by the consumer.
Orders are delivered as quickly as possible and within 30 days unless agreed otherwise. If delayed, the consumer is notified within 30 days and may cancel the contract.
All delivery times are indicative; no rights can be derived from them.
If cancelled, the trader refunds payments within 14 days.
If an item is unavailable, the trader may deliver a replacement, clearly indicated on delivery. The right of withdrawal applies to replacements. Return costs are borne by the trader.
Risk passes to the consumer upon delivery.
Article 12 – Long-Term Agreements: Duration, Termination & Renewal
Termination
The consumer may terminate:
-
indefinite agreements for regular delivery at any time with one month’s notice;
-
fixed-term agreements at the end of the term with one month’s notice.
Termination must be possible in the same manner as the agreement was concluded.
Renewal
Fixed-term agreements may not be automatically renewed except:
-
newspaper/magazine subscriptions may be renewed for up to 3 months with a one-month termination period;
-
fixed-term agreements may be extended indefinitely only if the consumer may terminate with one month’s notice (or three months if delivery is less frequent than monthly).
Trial subscriptions end automatically.
Article 13 – Payment
Unless otherwise agreed, amounts due must be paid within 7 working days after the cooling-off period begins.
For services, payment is due after order confirmation.
Consumers must report incorrect payment details immediately.
If the consumer fails to pay, the trader may charge reasonable collection costs.
Article 14 – Complaints Procedure
The trader has a complaints procedure and handles complaints accordingly.
Complaints must be submitted within 2 months of discovering a defect.
Complaints are answered within 14 days. If more time is required, an acknowledgement and time estimate will be provided.
Unresolved complaints become disputes.
Consumers must first contact the trader. Complaints may also be submitted via the European ODR platform: http://ec.europa.eu/odr.
Submitting a complaint does not suspend obligations.
If a complaint is justified, the trader will repair or replace the product free of charge.
Article 15 – Disputes
Dutch law exclusively applies to these Terms & Conditions and any agreements between the trader and consumer, even if the consumer lives abroad.
The Vienna Sales Convention does not apply.
Article 16 – Additional or Deviating Provisions
Additional or deviating provisions may not disadvantage the consumer and must be provided in writing or via a durable data carrier.
Article 17 – Mr Fold Campaign Emails
Customers who make a purchase may receive emails about offers, campaigns and new products via our email marketing system (Klaviyo).
Customers can unsubscribe at any time via the link at the bottom of each email.
